Our office has an attorney on-call 24 hours a day, seven days a week, in order to be
available to law enforcement. Each senior attorney in the office has a cellular telephone
in order to be accessible to law enforcement no matter what time it is, no matter what day
of the week, and no matter where they are. Moreover, we provide our home telephone number
to the law enforcement agencies so that we can be connected at any time if legal advice is
needed. It is extremely important for law enforcement personnel to be able to reach an
attorney for advice regarding search warrants, investigative procedures, and charging
decisions. Moreover, we often respond to crime scenes to be available for any questions
that might arise in the course of an active investigation.
The prosecutors in this office review all serious felony cases prior to presentment to
the Grand Jury to ensure that all necessary investigative work has been completed. Within
72 hours of making a felony arrest, the lead investigator will schedule an appointment with
the prosecutor handling the case. In this way, the investigation can be discussed with an
eye toward what evidence would be needed for a successful prosecution. For example,
photographs of the crime scene and/or victim's injuries, a crime scene diagram, a search
warrant for the suspect's home, car or business, DNA testing, fingerprint examination, etc.
This process makes it possible for the prosecutor who will be handling the case at the trial
stage to become involved in the case very early on in the investigation.
